License Agreement

1. All rights of the included software and documentation remain unrestricted property of SYBERA. Each voilation of the license agreement or copyright will be pursued by international law.

2. The customer is not legitimate, to remove any copyright notes or all other references to industrial protection rights in the programs or documentation. The software may not be decompiled, not disassembled and not be manipulated in any way. This remains validly for any kind of the use.

3. Unregistered SYBERA software versions or modules serve for exclusive use of demonstration purposes. They may be tested by the user within the given test period. Each further use (e.g. commercial use) presupposes the purchase and the registration of the software and is subject to the respective license agreement of SYBERA.

4. As freeware marked programs or modules may be used and shared freely under regard of the usufructs and copyright notes of SYBERA.

5. A Developer-License authorize to the installation of the corresponding SYBERA software product on one (1) workstation. Any publishing or distribution of a compiled application or driver with SYBERA software require the purchase of corresponding Runtime-Licenses.

6. A Runtime-License authorize to exclusive distribution of the SYBERA runtime (*.DLL and *.SYS) files which incorporate with a compiled application or driver on one (1) computing device or system and require at least the purchase of one (1) Developer-License.

7. As unlimited declared Runtime-Licenses refer exclusively to a specified product and require at least the purchase of one (1) Developer-License. A product is defined as a combination of one (1) specified hardware with varying applications, or as a combination of one (1) specified application with varying hardware. The use of the SYBERA software with different products requires additional Runtime-Licenses.

8. The Certification of License is regulated by the Product Enabling Code (PEC) and the certification label which requires the direct attachment of the certification on the hardware.

9. The right of usufruct is not transferable and commercial distribution without prior written agreement from SYBERA is strictly forbitten. An effective transfer presupposes, that the complete address of the new user or customer will be given to SYBERA and the new user acknowledges the software license agreement. Registered runtime versions remain untouched from this regulation.

10. SYBERA distributes the software through the concept of evaluation. The customer gets the ability to test the software product with complete functionality sufficiently before purchasing it. Therefor SYBERA takes over no assurance or warranty for the totality, functionality or accuracy of the included software or documentation. Particularly no liability is taken over for direct or indirect damages, which emerges from installation or any use of the included software.

11. Possible otherwise agreements or regulations are replaced by this license agreement. If individual contents are or should become ineffective, it does not touch the effectiveness of the remaining contents.

12. Jurisdiction is Stuttgart/Germany
